GENERAL TERMS AND CONDITIONS (GTC)

1. General

The general terms and conditions, as amended from time to time, apply to all our contracts and services. These GTC are considered to have been accepted upon placement of an order for a product from our range, at the latest. 
Our purchase and delivery terms and conditions apply to all written, telephone and online orders and are accepted every time an order is made.
Alternative terms and conditions used by the buyer are only valid when they have been explicitly accepted in writing.

2. Object of the contract

All offers are subject to change. A purchase contract is only concluded when written order confirmation is sent by email. If the ordered goods are not available, the seller has the right to not deliver the goods. Likewise, we reserve the right to withdraw from the sale if products are clearly wrongly advertised and labelled with incorrect prices.

3. Prices

Prices are given in Swiss francs. There is also a button for displaying the prices in euros. Prices include legally applicable VAT (in Switzerland 8.1% VAT) plus shipping costs. However, items with printed logos are shown without VAT - this is noted in the respective prices. We reserve the right to change prices. Promotional prices and customer discounts are only valid until cancelled.

4. Payment

Items can be paid for in Switzerland by invoice (via an external payment provider, MF Group/POWERPAY ), prepaiment, Apple Pay, TWINT, PayPal or with a wide range of cards.

5. Shipping costs

The following options are available for delivery:
In Switzerland:

• Pick up at one of our locations
   free of charge
  The processing time for collection in one of our branches is approximately 1 to 7 working days. You will receive an email as soon as the items are confirmed and are expected to be ready for collection the next day.
• Shipment
  

  CHF 7.90  -  free shipping for orders over CHF 250.-.

  We will select the appropriate sender for your shipment (Swiss Post, DPD or others).

6. Delivery time and scope of delivery

Items marked "In Stock" will be delivered within 1 to 5 working days.
Items that are not currently in our warehouse will be ordered from our supplier. You will be notified of a delivery time. It may be the case that such items can no longer be delivered. If so, the item will be deleted from your order, and you will be informed by email and if possible offered an alternative item. Payments already received will be refunded.
Depending on the delivery circumstances, partial deliveries take place at our discretion, unless the order confirmation explicitly states otherwise.
Delays in delivery do not entitle the customer to withdraw from the contract or to claim damages. 
Claims for damages due to delayed or non-delivery are excluded.

7. Cancellation policy

You can return products bought from us within the allowed return period. Please send us your cancellation notification (return request) in writing by email within 14 days of your receipt of the goods. The deadline will be considered to have been met if the return request is sent within 14 days.

When the customer exercises the right of cancellation, the purchase contract becomes a return contract whereby the services rendered as part of the purchase contract must be reimbursed. If you wish to cancel your order, please return the goods promptly in their original packaging.

We ask you to enclose a copy of the delivery note. This makes it easier for us to identify your goods.

The costs for sending and returning the goods are to be borne by you.

We will refund your payments immediately upon receipt of the goods via whichever payment method you used to pay (within 5 days).
We reserve the right to deduct compensation for any damage or excessive wear and tear from the refunded purchase price.

Please be aware that we do not accept returns of the following products:

Goods made to customer specifications or clearly tailored to personal requirements (e.g. embossed, engraved, customised, custom fitting).

The right to withdraw expires prematurely in the case of contracts involving the delivery of sealed items that are not suitable for return for reasons of health and safety or hygiene. The same applies to sound or video recordings or computer software, i.e. items delivered in a sealed package, if the seal has been removed after delivery.

Returns Procedure

If there is any doubt about whether a product can be returned according to the right of return described above, please take note of the points below in order to avoid having to pay compensation.

• Please return items in the original packaging. This includes product labels and the like.
• Please return the product in its entirety - this means all the delivery contents, including all accessories.
• Please pack the returned goods appropriately.
• Please ensure that the returned goods are undamaged and clean.

The goods can be returned by a shipping company or free of charge in an Umbrail Golf Import shop.
We ask you to enclose the delivery note or the order confirmation. This makes it easier for us to identify your return.

After the goods have been received, Umbrail Golf Import AG will check the return and decide whether it is in perfect condition and whether a credit note (or, if desired, an exchange) can be given. Your payment will be refunded within 5 days via the same payment method as the original payment.

Free in-store returns

Goods can be returned free of charge in an Umbrail Golf Import store. Please bring the delivery note or the order confirmation to help us identify your order.
Please note that the refund will be made via the same payment method as your original payment and not in the form of cash.

8. Retention of title

All delivered goods remain the property of Umbrail Golf Import AG until full payment is received. We are entitled to register retention of title in the retention of title register of the canton of domicile.

9. Warranty

If we accept that there is a defect in the purchased item, we are entitled to rectify the defect or to deliver a replacement, at our own discretion. Unless otherwise agreed, the warranty lasts for 24 months from the date of purchase. The warranty provisions of the respective manufacturer apply. Any further claims of the buyer are excluded, irrespective of the legal grounds.

10. Electronic communication

You agree that contract-related communication can take place in electronic form.

11. Data protection declaration

12. Printing and data errors

We accept no liability for possible negligence regarding printing and data errors in our advertisements and/or on our website. We are not liable for inadvertently incorrect pricing, or mistakes in illustrations, product descriptions, or other texts such as e.g. vouchers, discount campaigns.

13. Disclaimer for external links

Umbrail Golf Import refers to other sites on the Internet with links on its website. For all these links the following applies: Umbrail Golf Import expressly declares that it has no influence on the design and contents of the linked pages. We therefore expressly disclaim all responsibility for any content of external sites linked to on www.golfimport.ch and claim no ownership of any such content. This declaration applies to all links displayed and to all content of linked pages.

14. Image rights

All images are owned by Umbrail Golf Import AG or its partners. Use of images without express permission is prohibited.

15. Place of jurisdiction

The place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is Waldkirch for both parties.

16. Final clauses

If any individual provisions of these conditions are invalid, this does not affect the validity of the remaining provisions. Any invalid provisions will be replaced by valid provisions that are as close as possible to the intended purpose.
Umbrail Golf Import reserves the right to amend the GTC and the other provisions of the contract at any time. Changes will be communicated to the customer in an appropriate manner.
By ordering, the buyer accepts the above contractual terms and conditions.
